Terms and Conditions

1.1 Buyer — an adult who places an order on the website and enters into an agreement with the Seller.

1.2 Seller — NEXTLAYER SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, trading as BabyTruthsBooks, ul. Kordeckiego 26, 05-126 Nieporęt, Mazowieckie, Poland, KRS 0001177398, NIP 5361991807, REGON 54195765000000, contact contact@neextlayer.com.

1.3 Agreement — the agreement between the Buyer and the Seller formed when an order is placed and paid.

1.4 Products — everything offered on the website:

• Digital book: a personalized 32-page illustrated book with 16 illustrated spreads, delivered as a high-resolution PDF.
• Physical book: the same book printed as a square 21.6 × 21.6 cm (8.5 × 8.5 in) case-wrap hardcover, made to the Buyer’s specifications.
• Credits: optional packs that allow extra illustration requests inside the service.

Products are created in part with generative artificial intelligence (AI). Illustrations and text can vary and contain small imperfections, and illustrations are an artistic interpretation, not a photographic likeness of any uploaded photo.

These terms apply to every offer and every distance agreement between the Buyer and the Seller. The Shipping, Cancellations & Returns Policy and the Privacy Policy form part of them. Deviations apply only if agreed in writing.

You must be at least 18 and able to enter into a contract. If you provide a child’s name, description or photo, you confirm that you are the child’s parent or legal guardian or otherwise have every permission required.

3.1 Offer. Offers on the website are without obligation unless stated otherwise. We may change prices and specifications. Obvious errors in an offer do not bind us.

3.2 Free start. Each eligible account can create one book for free up to its opening illustration: one AI story draft, one character reference set and one standard opening illustration, with unlimited manual editing. It is tied to one book and cannot be moved, renewed or reset. The remaining illustrations, final images, the PDF and printing require a purchase.

3.3 Ordering. The agreement is formed when you choose a product, see the total in Stripe Checkout, accept these terms, complete payment and receive confirmation by email.

3.4 Refusal. We may refuse or cancel an order, for example if its content appears to infringe the rights of others (such as well-known characters) or breaks our content rules (Article 10). In that case we refund any amount paid for work not yet delivered.

4.1 Prices. Prices are shown in US dollars. Any tax that applies is shown in checkout before you pay. Current plans:

• PDF storybook: $24.99. Create the full book, approve every illustration, and download the high-resolution PDF. No physical copy is included.
• Physical book + PDF: \$49.99. The complete PDF plus one personalized case-wrap hardcover. Shipping and applicable tax are confirmed separately.
• Print upgrade for a digital book: \$20.00.
• Credit packs: 12 credits for \$7.99, 30 credits for \$17.99, 60 credits for \$32.99.

Each book plan covers one book. Every spread includes 3 standard preview requests and 1 high-detail final request; the cover includes 3 previews and 1 final. A request that fails for a verified technical reason is restored. After an allowance is used, credits can be spent: a standard preview costs 1 credit, an extra character set 3 credits and an extra final 8 credits. Credits have no cash value, cannot be transferred and are not subscriptions.

4.2 Shipping. Shipping and any tax for a physical book are not included in the plan price. They are quoted live and paid in a separate checkout after you approve the final proof.

4.3 Price changes do not affect orders already paid.

4.4 Payment. Payments are processed by Stripe. We begin work only after full payment.

5.1 Digital books are available in your account as soon as the illustrations are complete and you create the PDF.

5.2 Physical books are printed only after you approve the final proof, print specification, delivery address, shipping method and total. The production and delivery estimate is shown before you pay. If we cannot ship within that time, or within 30 days if no time was stated, we will ask whether you accept a new date or cancel and refund the unshipped book.

5.3 Address. You are responsible for a complete and correct delivery address. The risk of loss or damage passes to you when the book is delivered.

5.4 Your files stay in your account for as long as the project or account exists, so you can download the PDF or order another copy. They are deleted when you delete the project or account. If we ever stop storing files, we will give at least 3 months’ notice.

6.1 Personalized products. Our books are made to your specifications and are clearly personalized, so the statutory right of withdrawal does not apply to them (Art. 38(1)(3) of the Polish Consumer Rights Act). The digital book is likewise created to your specifications, and its creation starts at your request right after payment.

6.2 Cancellation. You can cancel an unused book plan for a refund before the first custom generation begins. A physical book can be cancelled until it has entered production.

6.3 Digital books cannot be returned once generation has started, except where the law requires otherwise or the service materially fails to deliver what you bought.

6.4 Physical books cannot be returned for change of mind. You are responsible for checking the proof for errors in text, names and illustrations before you approve it; errors that were already in the approved proof are not a defect. If a book arrives damaged, has a clear printing defect or differs materially from the approved proof, report it to contact@neextlayer.com within 30 days of delivery with a description and photos. We will send a free replacement; a refund is offered if a replacement is not reasonably possible. Details are in the Shipping, Cancellations & Returns Policy.

AI can produce unexpected or imperfect text and illustrations. Small deviations, stylistic choices of the AI, or illustrations that do not exactly match uploaded photos are not a defect. Neither are small differences at the edge of an illustration caused by trimming in professional printing, or printed colors that differ slightly from your screen.

You can edit every sentence and request new illustrations within your allowances before you approve the book. This is the main way to make the book match your wishes before printing.

Statutory consumer rights still apply: the product must match what you can reasonably expect of a personalized, AI-assisted book.

You are responsible for the photos, names, text and instructions you provide. You confirm they are lawful and do not infringe anyone’s rights, including copyright (for example well-known characters), trademarks or image rights, and you indemnify us against third-party claims caused by content you asked us to include.

You keep the rights you have in your content. You give us and our processors a limited licence to store, process, transform, print and deliver it only as needed to provide and secure the service.

All rights in the website, software, texts and images on it (except material you upload) belong to us or our licensors.

After full payment you receive a non-exclusive, non-transferable licence to use your personalized book, digital and printed, for personal, non-commercial purposes. You may not sell, publish or commercially exploit it without our written consent. We do not guarantee that AI-generated material is unique or protected by copyright.

You may not upload photos or give instructions that are unlawful, threatening, defamatory, hateful, sexualized in any way involving minors, or that infringe intellectual-property rights, including requests for copyrighted characters or protected logos. You may not bypass payment, generation, security or rate limits, or scrape the service. We may cancel non-compliant orders, suspend the account and claim damages.

Our liability is limited to direct damage and to the price of the product concerned. We are not liable for indirect or consequential damage, lost profits or non-material damage, nor for dissatisfaction with the AI’s artistic interpretation where the book largely follows your input and choices.

These limits do not apply to damage caused intentionally or through gross negligence, or where the law does not allow them.

We process personal data as described in our Privacy Policy. Before any reference photo is processed, you must accept the Photo & AI Processing Notice.

We are not required to perform an obligation when prevented by circumstances beyond our control, such as outages of essential providers, carrier disruption or government measures. We will tell you and offer a new date or a refund for undelivered products.

We may change these terms. The current version is always on the website. The version in force when you placed your order applies to that order.

These terms are governed by Polish law. This does not take away the protection of mandatory consumer rules of the country where you live. Disputes go to the competent court under applicable law; as a consumer you may also bring a claim in the courts of your place of residence where the law allows.

You can also turn to an out-of-court consumer dispute body or consumer authority in your country. In Poland, information is available from the Office of Competition and Consumer Protection (UOKiK).
